男子遭艾滋针扎伤告医院索赔12万多 法院已受理

29岁的张明(化名)起诉称，因地坛医院管理不善，致使自己被一支刚为艾滋病(呈阳性)病人抽过血的针头扎伤右脚。为此，他向地坛医院索赔12万余元。昨日，朝阳法院证实已受理此案。
张明在起诉书中称，今年3月17日，他前往地坛医院探望病人。早上6点左右，地坛医院的一名护士在给患有艾滋病(呈阳性)的病人抽过血后，针头未放好，掉落后刺伤了他的右脚外侧面，右脚当即流血。
事情发生后，地坛医院要求张明住院治疗一个月。之后医院让他返回家乡继续观察半年。张明称，在此期间，医院仅支付医疗费及部分往返费，而拒绝赔礼道歉且不进行赔偿。
张明认为，病毒有潜伏期，地坛医院作为医疗机构自身管理不善，且医护人员未尽注意义务，给其本人以及家庭造成了极大的精神伤害。
昨日，张明的代理律师马先生说，虽然经过医院检查，没查出感染艾滋病毒，但在医院住院服用药物时，张明经常头晕、脱发厉害。
“他的精神压力非常大，因为艾滋病毒有潜伏期，他总担心自己感染了病毒，不敢跟妻子同房。”马先生说，张明被针扎伤的事，只有妻子知道，至今仍不敢告诉家里的老人和单位同事。
昨日，记者致电地坛医院宣传处、医院办公室以及负责艾滋病治疗的感染一科，均得到答复为“不清楚此事”。
