七旬老太被诊断患艾滋病 异地治疗半年发现误诊

年逾七旬的曹老太因患胸积水到西安治病，不想被诊断为“艾滋病”！ “我都70多岁了，怎么会患艾滋病呢？”带着绝望的心情，老太回到了昆明，住进了专科医院。几经检查，医院给了她一个惊喜——所谓“艾滋病”纯属被误诊！昨天，在《侵权责任法》实施的第一天，曹老太向西山区人民法院递交了诉状，把西安市疾控中心和西安市第五医院告上法庭。这是昆明第一场《侵权责任法》官司。
患胸积水入院，被查出“患艾滋病”
“我70多岁了，竟莫名其妙当了近一年的艾滋病人！”提起自己的遭遇，曹老太很是激动。
2008年9月底，曹老太患上了胸积水。因她的大女儿在西安，说西安的医疗条件好，就把她接到西安去治疗。经西安市第五医院门诊诊断，曹老太患有胸膜炎、胸腔积液。当天，曹老太决定住院治疗。
不料，在治疗过程中，西安市第五医院检查出曹老太患上了一种更可怕的疾病。该医院检查结果显示，曹老太的HIV抗体呈阳性——她患了艾滋病！这把曹老太吓坏了，“我都70多岁了，根本没有感染艾滋病的途径，怎么还会得艾滋病……”得知检测结果，曹老太当时就急哭了。
2008年10月6日，西安市第五医院将曹老太的血样送往西安市疾病预防控制中心进行检测。两天后，西安市疾病预防控制中心的检测结果粉碎了曹老太的希望。“HIV抗体确认检测报告单”上的结论为“HIV-1抗体阳性”。
同时，曹老太的名字被登上了卫生部门内部的“艾滋病专报网”，因为艾滋病检测实行实名制，一旦确诊艾滋病，要在“艾滋病专报网”上登记姓名，以利于艾滋病的防控。也就是说，曹老太的名字上了这个内部网，全国的卫生部门都能看到。
误诊！曹老太喜极而泣
带着绝望的心情，曹老太返回了昆明，“我怎么也想不通，天天都在哭。而且我的名字上了‘艾滋病专报网’，全国的医疗机构都知道了！”家人知道了曹老太的诊断结果后，儿子在网上查询了相关资料，得知云南有个艾滋病关爱中心，就在省传染病医院。便为曹老太联系好，让她入院治疗。
2009年2月24日，曹老太住进了云南省传染病专科医院。“刚到医院时，我心里很难受，医生护士一次次地开导，让我慢慢平静下来接受治疗。通过了解相关知识，我开始觉得艾滋病不可怕了。”在传染病院，曹老太认识了很多病友。
治疗过程中，医院发现曹老太没有发生艾滋病引起的各种机会性感染。而且，在没有采取任何艾滋病治疗措施的情况下，她体内的CD4+细胞(病毒抗体)竟然自行恢复了。云南省传染病专科医院决定，对曹老太再次进行HIV抗体筛查。
省传染病院感染一科主任王丽在接受采访时介绍：按照惯例，一个地方的疾病预防控制中心确诊的艾滋病，其他地方和机构一般不再复查。要做复查，就像推翻一个已经定性的案子一样，需要非常慎重。医院先后用了5种不同的检测方法为曹老太复查，结果都是“HIV1/2抗体阴性”——曹老太没有患艾滋病！
2009年7月，当拿到云南省传染病专科医院的HIV抗体筛查报告时，曹老太又哭了。这次，她流下的是喜悦的泪。
用《侵权责任法》维权，她是昆明第一人
对于自己的“被艾滋”，曹老太很是气愤，她委托云南震序律师事务所的张宏雷律师为她主持公道。
“复查结论已充分证明，西安市第五医院与西安市疾病预防控制中心对曹老太作出患有AIDS的结论系误诊。误诊给曹老太及她的家庭带来了莫大的精神打击。更为重要的是，西安市疾病预防控制中心将曹老太的姓名公布在‘艾滋病专报网’，这给她的名誉带来了极大的侵害！”张宏雷律师介绍，为了尽快解决这次误诊给曹老太及其家人带来的伤害，他曾多次致函西安市第五医院与西安市疾控中心，要求两单位就误诊这一后果采取积极措施，提出解决问题的妥善方案，但直到现在，两单位都没有给出确切的答复。
昨天，曹老太向西山区人民法院递交诉状，状告西安疾控中心和西安市第五医院，开打《侵权责任法》昆明第一案。她提出，因两单位将自己的姓名公布于“艾滋病专报网”，侵害了她的名誉权，要求两单位为她恢复名誉、消除影响并赔礼道歉，同时赔偿因误诊导致的相关损失1万元、精神损害抚慰金9万元。
从曹老太知道自己“被误诊”到现在，已过去了近一年的时间，为什么曹老太非要等到昨天才起诉呢？张宏雷律师一语道破：“这就是为了等《侵权责任法》施行。适用新法，曹老太可能获得更多赔偿。”
张宏雷律师解释：在这起案件中，曹老太共索赔10万元，其中精神损害抚慰金就有9万元。“以往精神损害抚慰金只是散见于各种司法解释、法规中，很多时候是由法官自由裁量。而《侵权责任法》第一次以法律的形式认可了精神损害抚慰金，那么，曹老太获赔的几率就会大大增加。”
“今年7月1日起施行的《侵权责任法》第57条规定，‘医务人员在诊疗活动中未尽到与当时的医疗水平相应的诊疗义务，造成患者损害的，医疗机构应当承担赔偿责任’。最高人民法院相关司法解释说，‘医疗卫生单位的工作人员擅自公开患者患有淋病、麻风病、梅毒、艾滋病等病情，致使患者名誉受到损害的，应当认定为侵害患者名誉权’。”张宏雷律师表示：两单位作为医疗机构，未尽到与当时的医疗水平相应的诊疗义务，给曹老太及其家人的身心都造成了极大的伤害，应承担相应责任。此外，《侵权责任法》中，以“专章”的形式规定了医疗纠纷的处理，取代了以前医疗事故鉴定办法的规定，对于患者来说更趋公正。“总之，《侵权责任法》内容丰富，调整范围广阔，它的出台使大家的合法权益能得到更加公平和充分的保障。我们等的就是这个！”
为什么会出现艾滋病误诊？
“令人不安的是，此事并不是西安市疾控中心误诊艾滋病的孤例。2006年，西安市疾控中心就因误诊艾滋病，且将患者姓名公布于‘艾滋病专报网’上，被法院判令做出赔偿。可他们仍未吸取教训，误诊对医院来说只是一个简单的‘更正’，但对患者及家人的伤害却是巨大的。”张宏雷律师表示。
就全国而言，被误诊为“艾滋病”的，不仅仅是曹老太一人。西安市民冯战强、黑龙江男孩小亮都有这种遭遇。为什么会这样呢？
疾控中心的官方解释为：HIV抗体“前阳后阴”有4种情况，一是送检血样弄错，二是送检血样被污染，三是实验室差错，四是出现艾滋病“精英”现象(先确诊阳性而后转阴)。
“检测过程中，很多环节都可能影响到检测结果。比如，检测过程中血液有一点点的污染，就会影响到检测结果。还有，患者其他免疫系统疾病和自身抗体的问题，也会影响检测结果。”对于曹老太前后的检测为什么会不同，云南省传染病院检验科主任杨绍敏在接受采访时分析：曹老太的HIV检测结果出现了“假阳性”，自身免疫抗体出现问题的可能性比较大。
那么，艾滋病感染者是否有自愈的可能？杨绍敏表示，网上看见过国外有这种说法，但目前云南省还没有这样的例子出现。
