雷钟哲：“拉拉”婚礼公开的社会意义

历史——至少是婚姻史——注定要记住这个时刻，在2011年的元旦，广东中山一家酒店举行了一场不同寻常的婚礼：穿婚纱、切蛋糕、拜天地、互换钻戒……这些“程序”，和其他“中西合璧”式的婚礼，并没有太大的不同，唯一不同的是，结婚的是对“拉拉”，即两个同性恋的“女人”——32岁的“PACO”和28岁的“水晶”。（1月10日《华商报》）
据报道，这是广东首对公开举行婚礼的同性恋人，在中国也十分罕见。因为直到目前，同性结婚还不受我国法律的认可。所以所谓“婚礼”，不过是同性恋者想以夫妻名义共同生活的表达。尽管这种诉求，无法得到《婚姻法》的保护，但在我国的刑法里，你也找不到禁止同性恋的法律条文。依照私权“法无禁止即可行”的原则，同性恋“结婚”，也就不是犯罪的行为。事实也是，虽然以前有过以“流氓罪”惩罚同性恋的案例，但自从1996年全国人大表决通过新的《刑法》，对流氓罪的内容给予了更为明确的解释以后，同性性行为并不包括在内，也就是说在中国，同性恋现在完全非罪化，这体现了社会的进步与宽容。
但是我们应当看到，同性性行为已经成为我国艾滋病传播的主要途径，几乎占到传播总数的三分之一；而导致艾滋病传播的同性性行为，绝大多数来自“同志”（与“拉拉”相对，指男同性恋者）。可遗憾的是，由于民众对于艾滋病的无知和偏见，艾滋病患者甚至家属，常遭到不同程度的歧视（《中国艾滋病感染者歧视状况调查报告》显示：约有40%的感染者，曾经遭受与艾滋病有关的歧视，有超过三分之二的人的家庭成员，因为自己的感染状况受到株连。）这就必然使艾滋病患者——包括其中的同性恋者——成为更加隐秘的社会群体，滋生更加潜在的社会危害。仅从这个意义上说，同性恋公开举行婚礼，表明自己的身份，就是一种勇敢的正视。
我们必须承认，同性恋是一个客观存在的群体。因为遗传、环境、风气、教育等诸多因素的影响，使某些人把性爱、心理、情感上的兴趣对象，指向自己的同性，别的人谁也无法阻止他们之间的性行为。不说域外，中国从古至今亦是如此，所谓“龙阳之好”、“分桃之恋”、“断袖之癖”，加之现在同性恋者的人口估计，无论1%还是10%，都证明这个群体的真实存在。既如此，就应当正视客观事实，不应当采取鸵鸟政策。比如前年（2009年），云南省大理市卫生局，就出资开办以同性恋为主体顾客的酒吧。其目的，就在于通过酒吧这个平台进行“同伴教育”（09年11月29日《新京报》），这就是一种积极的态度。总之，我们宽容和尊重同性恋者的婚礼，既是符合人性的选择，也是对自己的爱护，远比抵触和否认的做法，现实有益得多。
