男子参加教师招聘考试被查出感染艾滋遭拒录

晓静(化名)在贵州某县一个小山村学校代课3年,今年在参加三都县的教师招聘考试中,因为体检查出感染了艾滋病毒,因此被三都县拒绝录用为正式教师。记者9月28日电话采访晓静了解到,晓静已经委托律师将三都县政府及人力资源和社会保障局(以下简称“人社局”)起诉至黔南州中级人民法院。
代课三年想圆教师梦 感染艾滋被拒录用
晓静告诉记者,其自小就有着当老师的梦想。2008年夏天,晓静从师范院校毕业后,选择到贵州省某县的一所山村学校代课,成为一名教师。
晓静说,尽管自己只是一名代课老师,但是自己十分的努力工作,为了这个光荣的职业尽力做好一切。从2009年开始,晓静参加了每次的教师招聘考试,在前两年,因为没有复习好,所以没有得到进入体检资格。
今年4月1日,晓静看到三都县面向社会公开招聘教师若干名,十分高兴地去报名参加了考试。经过努力,晓静以优异的成绩通过了笔试和面试。
6月23日,由三都县人社局安排,晓静到该县县医院进行体检。7月13日,公布体检合格的名单中,却没有晓静的名字。后该县人社局的工作人员电话通知,声称晓静的HIV检测为阳性,不符合教师录用资格的体检标准,所以取消了晓静的教师录取资格。
当事人:不应该被歧视
9月28日,记者电话采访了晓静。在电话中,晓静告诉记者,当得知自己被告知感染艾滋病毒的时候,一下子就蒙了,自己也不知道是为什么、何时感染艾滋病毒的。
“那一刻我有了心碎的感觉,不仅因为自己是HIV感染者,还有我可能彻底地失去了做老师的梦想。”晓静说,他特别喜欢教师这个职业,并且自己也特别希望能够成为一名正式的教师。令他不解的是,国家有明确的法律政策规定要保障HIV感染者的生活和就业问题,为什么自己就不能当教师呢?
目前,晓静已经委托律师将三都县政府及人力资源和社会保障局起诉至黔南州中级人民法院。据悉,该案立案,将是贵州第一例因为歧视HIV病毒感染者而被起诉的案件。
记者从晓静的代理律师陈文胜处了解到,他根据晓静的委托,请求人民法院依法确认被告认定原告体检不合格不予录用的行为属就业歧视的违法行为并依法予以撤销;请求人民法院责令被告就录用晓静为该县正式教师一事重新依法作出具体行政行为。
专家:文化歧视很难根除
陈文胜表示,《就业促进法》规定了“用人单位招用人员,不得以是传染病病原携带者为由拒绝录用”,那么,“艾滋病病毒感染者就应该享有平等的就业权利,包括教师等不会传播艾滋病的职业。”陈文胜认为,《就业促进法》是全国人大常委会制定的法律,部门法规、规章制度不得与此相抵触,三都县招聘办所依据的《公务员录用体检通用标准》部分条款无效。
贵州洲联合律师事务所副主任李向玉律师认为,教育机构是特殊的部门,直接面对学生,因此,三都县政府所进行的体检标准是为了维护学生的身心健康。但从另一方面来讲,晓静在不知情的情况下去报考,并没有隐瞒的故意,说明其对教育事业的热爱,如果通过短暂的治疗能够使其走上教育岗位,也是人性化、以人为本的社会理念的运用。
贵州衡一律师事务所律师蔡远说,从法律方面来看,事业单位组织招生考试并设置相应的条件和要求,属于一种行政行为,当事人对行政行为不服的,可以提起行政诉讼。晓静认为招聘机关违反了法律、法规,侵犯其平等就业权,其可以依据《劳动法》第三条“劳动者享有平等就业和选择职业的权利”提起诉讼。
我国现行法律中,《劳动法》、《就业促进法》、《艾滋病防治条例》等法律法规都有对艾滋病患者的保护规定,但是,实践中效果并不明显。由于有《公务员录用体检通用标准(试行)》的规定,艾滋病“不合格”,并出现以此为依据拒绝招录艾滋病毒感染者成为教师的案件在国内各地都非常普遍,根据以往的判例感染者均被判败诉。
“对于艾滋病病人和感染者的歧视分为两种:第一种来自制度性歧视,第二种则是文化性歧视。制度性歧视可以通过调整法律、政策来解决,而文化歧视却很难从人们的大脑中删除。”蔡远说。(贵州商报 记者 高荣华)
