失足女患艾滋仍与嫖客交易 被判传播性病罪

卖淫女明知自己有艾滋病，仍与嫖客进行皮肉交易，结果触犯刑律。昨日，柳州市柳南区法院一审以传播性病罪，依法判处被告人熊某有期徒刑10个月，罚金3000元。记者了解获悉，此案是柳州市法院系统首次以传播性病罪罪名，追究卖淫女刑事责任的案件。
去年5月17日凌晨2时许，柳州警方在谷埠街大同巷某旅社的一间客房内，将正进行皮肉交易的卖淫女熊某和嫖客阿勇抓获。熊某供认她患有艾滋病，随后公安机关将她送往专业卫生机构检测，证实熊确有艾滋病。公安人员将此结果通报给阿勇，希望他也进行相应检测。
警方调查得知，熊某今年35岁，原籍柳城县，案发前住在柳北区石碑坪镇。熊某称，她已经卖淫多年，平时在江滨公园一带“揽客”。由于长期卖淫，熊某在2008年9月发现自己患上了艾滋病，但她没有就此收手，继续操持“生意”。案发前，阿勇主动接触熊某，双方商定以50元一次的价格发生性关系，到大同巷某旅社开房。
熊某被抓后，先后被公安机关决定行政拘留10日、收容教育6个月；去年6月，熊某因为涉嫌传播性病罪，被转至看守所羁押。柳南区法院审理认为，熊某明知自己患有严重性病而卖淫，其行为构成传播性病罪；考虑到熊某自愿认罪，可酌情从轻处罚，由此作出上述判决。
法律人士介绍，传播性病罪在我国刑法第360条有明文规定，它是指行为人在明知自己患有梅毒、淋病等严重性病的情况下，仍然进行卖淫、嫖娼活动的行为；传播性病罪将直接传播性病，对他人身体健康造成危害。记者采访了解到，刑法虽然只明确梅毒、淋病等为严重性病，没有将艾滋病列为严重性病，但国家卫生部制定的《性病防治管理办法》中指定的性病有8种，除淋病、梅毒外，还包括艾滋病、软下疳、性病性淋巴肉芽肿、非淋菌性尿道炎、尖锐湿疣和生殖器疱疹。因此，后6种疾病也应当认定为严重性病，相关嫌疑人同样应当以传播性病罪被追究刑事责任。
法律人士称，传播性病罪有两个关键条件，一是必须明知自己患严重性病；二是进行卖淫嫖娼活动。因此类似一夜情、酒后乱性和婚外恋等传播性病的，不能定传播性病罪。 (南国今报 杨建林 杨卉)
