为帮老板平事 艾滋病患者咬人被公诉

本报讯（记者穆奕 通讯员任景慧）曹某20年前遭遇车祸，在输血时感染上艾滋病。去年年底，没有经济收入的曹某，纠集6名病友，利用自己艾滋病患者的身份，帮助雇主威胁“竞争对手”，并将对方手臂咬伤。昨天，海淀检察院以涉嫌寻衅滋事罪对曹某提起公诉。
据了解，今年40多岁的曹某，于20年前遭遇车祸，在输血时感染上艾滋病病毒。此后，其妻子及小儿子也成为艾滋病病毒携带者。由于患病，他根本无法找到正当的职业，家庭处境十分困难。
2003年，曹某带着妻儿从老家河南来到北京，希望通过打工改善一下生活境况，但始终没有找到固定的工作，收入也很不稳定。
去年年底，曹某一家搬进海淀区一廉价公寓里。当时，公寓的经营者是黄某。很快，黄某便得知曹某是艾滋病患者。此后不久，黄某在和“竞争对手”郭杰（化名）打争夺经营权的官司时败诉。
虽然交出了经营权，但黄某一心要将郭杰赶走。他想到了曹某，想利用曹某艾滋病患者的身份，威胁郭杰搬出公寓，交出经营权。
曹某在得知黄某的想法后，把这当成一次挣钱的机会，条件是在黄某处拿到稳定的工资和包吃包住的待遇。与此同时，曹某找到6名外地的病友，并承诺病友，如果来北京帮忙一起吓走郭杰，就可以每人得到1000元的好处费。6名无业的病友看到挣钱的机会，也都纷纷同意。
去年12月，6名病友全部搬进这家公寓。他们在楼道内大声宣称自己是艾滋病患者，并向来往的房客身上吐口水。同时，他们多次威胁郭杰交出经营权，郭杰始终坚持维护自己的权益，没有妥协。12月21日上午，曹某又带着病友前往公寓办公室闹事，再次企图以艾滋病患者身份恐吓郭杰。其间，双方发生了肢体冲突。在推搡中，曹某将郭杰的手臂咬伤。
看到有鲜血流出，郭杰马上报警，同时迅速赶赴医院进行治疗。在郭杰去医院的同时，曹某被及时赶来的民警抓获。经鉴定，郭杰的伤情构成轻微伤，因曹某是艾滋病患者，郭杰至今仍在接受艾滋病防疫治疗。
目前，该案中指使曹某进行威胁的黄某已被另案处理。
