艾滋病咋成了犯罪分子的“护身符”？(图)

　　司法机关为什么不将“艾滋嫌犯”绳之以法？因为没有收监的场所以及治疗等方面的经费，“艾滋嫌犯”们也因此更加有恃无恐。

　　两名男子拦路敲诈并抢劫保安员1800元钱，近日被广东东莞警方抓获。一名劫匪被判处劳教一年，另一名劫匪则在被捕当日即被释放。被劫的保安员质疑警方故意“纵贼”。警方称被释男子身患艾滋病，按规定不能拘留。（据7月21日《广州日报》）

　　按规定不能拘留违法犯罪分子？从来没有听说过这样的规定！我只知道，“法律面前，人人平等”。不管是谁，也不管他身患何病，只要违法犯罪了，都应该受到法律的惩罚。该拘留的拘留，该判刑的判刑，岂能因为违法犯罪分子患有艾滋病就让他们逍遥法外？

　　虽然不可能有这样的规定，但说它是“惯例”却不为过。近年来，各地公安机关对患有艾滋病或携带艾滋病毒的犯罪嫌疑人“捉放曹”的事情屡见不鲜。据报道，杭州曾有一个犯罪团伙，16人中有12人感染了艾滋病，公安机关对他们“屡抓屡放”，这引起了全国媒体的关注。

　　司法机关为什么不将“艾滋嫌犯”绳之以法？因为没有收监的场所以及治疗等方面的经费。由于艾滋病的传染性很高而且难以治愈，所以不能把他们与其他人员关押在一起，而绝大多数地方都没有专门的监所或监室。有的患病人员一旦收监，还要对其进行必要的治疗，这也是一个不小的负担。

　　也正是因为“放了抓，抓了放”，“艾滋嫌犯”们更加有恃无恐。很多患有艾滋病或携带艾滋病毒的人抱着“我有艾滋我怕谁”的态度，抢劫抢夺、肆意妄为，有的地方甚至出现了不法分子为了享受“艾滋特权”而故意感染艾滋病的情况。2004年6月，杭州警方曾透露：百余艾滋嫌犯因无处关押，游荡在杭城街头。数据表明，身患艾滋病或携带艾滋病毒的违法犯罪分子越来越多，艾滋病简直就成了一些违法犯罪分子的“护身符”！

　　无原则地释放“艾滋嫌犯”就相当于“放虎归山”，这进一步助长了“艾滋嫌犯”的嚣张气焰，其对社会的危害不言而喻。有人说，游荡在社会上的艾滋违法犯罪分子“比恐怖分子还恐怖”！这一社会问题早就引起了公众的担忧，也得到了人大代表及各地政府的重视。近年来，在广州市及广东省的两会上，曾有数十名人大代表建议监狱设置艾滋病等传染病监室。今年年初，广东省公安厅表示，原则上，一些地级以上市可以根据实际情况，设立专门收治场所，统一收戒和关押涉毒违法犯罪人员中的艾滋病病人等特殊人员。“艾滋嫌犯”问题的解决，说难也不难，无非是一个“钱”字。只要有了经费，可以建专门的监室，配备专业的人员。我认为，这个钱是必须花的，任何纳税人都不会反对。有报道称，2002年广东省财政厅就已下拨启动资金，2010年起每年还安排1019万元艾滋病专项经费。在病犯监狱没有启用之前，看守所要设立病犯监室单独关押。怎么到了现在，东莞还无法关押“艾滋嫌犯”呢？

　　问题已经说了很多年，到了该行动的时候了！
