昨日，甘肃省制定出台了《甘肃省艾滋病检测阳性结果告知工作规范（试行）》，首次将艾滋病检测阳性结果告知工作进行了明文规范。艾滋病病毒感染者、病人在得知阳性结果后一个月内必须将自己的感染状况告诉配偶或与其有性关系者，并负责促成配偶或与其有性关系者到当地疾病预防控制机构做咨询和检测。

告知时限一个月内告知配偶

《甘肃省艾滋病检测阳性结果告知工作规范（试行）》规定了告知本人或者监护人时限：责任告知单位接到艾滋病检测阳性确证报告单后一周内（以网络直报为准）完成告知工作。对于公安、司法系统监管场所被监管人员中的艾滋病病毒感染者、病人的阳性告知，根据不同监管场所的情况，由当地疾病预防控制机构与监管场所协商决定告知时间和方式。告知艾滋病病毒感染者、病人的配偶或与其有性关系者时限：艾滋病病毒感染者、病人本人必须在责任告知单位告知后一个月内，告知配偶或与其有性关系者。

告知方式面对面不得打电话发短信

在告知方式上，《规范》要求艾滋病检测阳性结果告知应该在相对独立、安静无干扰的场所以面对面的方式进行，原则上有2个责任告知人在场，不得采用电话、捎信、转告等方式告知。艾滋病病毒感染者、病人在得知阳性结果后一个月内必须将自己的感染状况告诉配偶或与其有性关系者，并负责促成配偶或与其有性关系者到当地疾病预防控制机构做咨询和检测。因未将自己的感染状况告诉配偶或与其有性关系者，且未采取必要的防护措施，则视为故意传播艾滋病，依法承担民事赔偿责任；构成犯罪的，依法追究刑事责任。

相关规定感染者18周岁后不必再隐瞒

    未成年的艾滋病感染者、病人年满18周岁后，原监护人应将感染状况告诉本人，并负责促成其本人到责任告知单位接受相关医学咨询。因原监护人未将感染状况告诉本人而造成的他人艾滋病病毒感染，原监护人将承担法律责任。检测阳性结果告知时责任告知人应出示艾滋病病毒抗体确证检测报告单，同时在告知完成后告知人和告知对象填写《艾滋病检测阳性结果告知书》（以下简称《告知书》）并签名。《告知书》一式两份，告知对象和告知单位各持一份。如果未完成告知，应在《告知书》上注明未完成告知的原因。告知对象为监护人时，应在《告知书》上注明其与感染者的关系。(金奉乾)
