“小姐培训惹争议”的政策思考
——从组织传播的“垃圾箱”决策谈起

2009年1月5日,一篇《广西宜州培训“小姐”惹争议》的帖子在网络上快速传播。帖子内容源自博客“糜瑞兰”写于2008年12月16日《宜州市疾病预防控制中心,你究竟在招什么》的博文。这篇博文发表之初,除了在几个博客圈被加为“精华”外,并没有引起太大关注。直到荆楚网将该内容写成报道后,才跟帖不断轰动网络。新华网、人民网、新浪、搜狐等各大门户网站均转载了相关图文。
事件缘起于我国正在成为艾滋病高危地区这一严峻现实。目前我国艾滋病病毒感染者约84万人。如不采取积极有效的措施,到2010年,中国艾滋病病毒感染者将超过1000万人。广西是我国艾滋病感染人数比较多的省份之一,众多的艾滋病感染人群中,有86%是通过性交途径感染艾滋病的。2008年4月,宜州市疾病预防控制中心以“爱心红丝带协会”名义申请了“广西全球基金第六轮艾滋病项目”,成为广西22家项目实施机构之一。该项目是国际组织援助中国的一个艾滋病预防控制项目,重点是利用民间组织对从事性服务的低档次暗娼进行干预。因此,尽管宜州市疾控中心“培训小姐”在宣传方面确实存在瑕疵,但其初衷是为了干预特殊人群,说白了就是到艾滋病最容易传播的地方,向高危人群做宣传艾滋病知识的工作。
“培训小姐”的消息见诸媒体后,既有对“糜瑞兰”观点进行批驳的,认为培训小姐可以“减少性病、传染病、艾滋病的传播,人人有责!”[1]也有表达震撼的:“连小姐都要培训了,还敢公开搞”、“这样真的是非常的彪悍”。[2]更多的网民是质问:公安机关在这边“扫黄”,疾控部门却在那边给“小姐”公开搞“培训”,这不是承认色情服务吗?
笔者在Google上以“小姐培训”为关键词检索,竟然命中577000个条目。在各大网站上,许多网民以《公开身份的〈性工作者〉公安还抓不抓》《为防艾滋病而使性交易合法化是因噎废食》《有了安全套就合法了吗》之类标题的批评文章连篇累牍。这些文字的火力主要集中在一个焦点上:疾控部门如此郑重其事地为“小姐”搞培训,在她们当中推广使用安全套,难道疾控部门不知道,性交易者在中国是违法行为吗?甚至还有网民认为,疾病预防控制中心进行这一类的“培训小姐”活动,表面上似乎有国策可依,是合理合法的,但是从深层次看,这种“闹剧”是公开对“小姐”卖淫的默认,是对国家法律的嘲弄、践踏和宣战。[3]
联想到近年来,我国许多地方的疾病防治部门开展的类似活动,无论是哈尔滨市疾控中心举办的“小姐培训班”,还是广州市“高危行为干预队伍”的队员带着近40位“小姐”宣读“健康誓言”,每次活动都会引起民众以及网络上的一场龃龉,一番论争。可见,“小姐培训”既透露出疾病防治者的无奈、执法者的尴尬,更有卫道者的叹息。
众所周知,性交易并不是个简单的社会问题,它有着十分复杂的社会成因,许多国家的政府都力图阻止这种丑恶的社会现象。而当政府试图阻止性交易者这种不法交易时,它必须决定是制止买主还是卖主。大多数国家的政府,都会将卖者定为追踪的目标和着力打击的对象,因为只有这样,才能使政府投入的资金获得最大的利益。因此,在美国,除了在内华达州的一些地方性交易被认为是合法的,性工作者必须到当地政府注册,并在特定的妓院范围内从事生意,健康机构每周为妓女做性病及艾滋病检查之外,美国其他49个州都把卖淫认定为非法交易,政府采取各种手段予以取缔。然而,你有政策,她有对策。由于固定地点太容易被警察发现和突袭,性工作者通常以街头流莺形式,经常改变地点以增加警察抓捕的难度。所以,美国政府禁止性交易的种种努力并没有取得令人瞩目的成功,或者说,美国政府在阻止性交易方面的无所作为,意味着这些努力的失败。因此,有美国学者从中得出结论认为,“当政府力图人为地阻止双方互利的交易时,即使再好的努力也不可能取得卓越的成功。”[4]我国政府长期坚持“扫黄”政策,有时甚至对性交易者实施“严打”,力度不可谓不大,所支付成本不可谓不高,但各地娱乐场所的“生意”始终禁而不绝。显然,单靠执法机关的打击无法根本性地解决性交易这一问题。
宜州市疾病预防控制中心“培训小姐”事件又唤起人们对于性交易是否应该合法化,性服务者是否有处置自己身体的权利,社会如何善待性服务者,保护性服务者的人身和财产安全等问题。也就是说,政府到底能否采取两全其美的政策呢?通过对组织传播中的垃圾箱决策方法的思考,笔者以为,在对待性交易者这一复杂问题的决策方面,我们必须注意政策的道德内涵、把握决策的恰当机会,等待合适的政策创新时间。
(1)注意公共政策的道德内涵。中国自古以来,就是一个具有强大的道德传统的国家。诲淫诲盗为历代社会所反对,性交易者历来为民众所鄙视。因此,轻易地让性产业合法化,保护性交易者的人身安全,不仅在社会上缺乏广泛的道德支持,政府显然也很难做到。这也是目前政府决策处于两难境地的根本原因:解决问题优先,保护弱势的性工作者的生命和健康,使性交易合法化,很为难;道德价值优先,严厉禁止性交易者,继续保持过去的政策,让弱势者的生命、财产继续受到黑恶势力的剥夺,健康继续受到危害,并且把性病传播给社会,也很为难。[5]显然,在当前这种两难处境之下,由疾控部门基于控制疾病和维护性工作者基本人权的角度进行“防艾”健康培训,用技术手段弥补执法缺陷,体现社会进步和公共部门的责任感,无疑具有积极的社会意义,这也是现实社会状况下的一个实事求是的次优的道德选择。
(2)把握政策决定的恰当机会。政府决策涉及方方面面的复杂因素,绝不仅仅是个简单的理性分析过程。组织传播理论对决策思考的“垃圾箱决策模型”认为,公共政策必须在特定的决策机会或要求出现时才可能做出。这是因为政府决策所涉及的政治活动,远比人们通常所设想的要多得多,各种不同的利益联盟之间在决策过程中要进行广泛的交易和冲突。对待性交易问题,世界各国政府都存在着激烈的争论,而许多政府的公共政策都有某种程度的举棋不定。这种情况只能说明政府有关性交易方面决策的时机尚不成熟。目前,我国无论是价值观还是法治都处于转型阶段,在这样的多元社会里,贸然轻率的决策可能引发更多的问题。因此,我们必须耐心等待政策决定的恰当机会。这种决策机会既可能来自于常规事件中具有的制度化的选择机会,也可能来自于由外部影响意外引发的选择机会,还可能来自于由社会过程造成的选择机会,而这种社会过程只能是由人们对性工作者问题所应当采取措施的认识不断增长而引起的。
(3)等待合适的政策创新时间。政府作为社会管理的最大组织,其决策不是随心所欲的。如果在某个环境中,行动者、解决方法、问题和选择机会之间有着复杂的相互作用,那么最简单的秩序来源就是时间。从很多方面讲,每个有效政策的创新过程都建立在时间类别之上,根据问题发生的同步性,把人、问题和解决方法结合起来。[6]因此,时间在政策创新中的制约力量是很大的。 比如在美国,1914年之前,可卡因交易是合法的,今天却不是。酒精饮料在今天的美国是合法的, 但从1920年到1933年之间却不是。卖淫在今天的内华达州是合法的,在另外49个州却不是。这充分说明,任何政府的决策都是一个不断适应社会变化的创新过程。这种创新的发生不仅取决于恰当的机会,更取决于正确决策的合适时间。也就是说,在政府决策创新过程中,存在一些外生的、依赖于时间的选择机会、问题、解决方法和决策者。往往一个合理有效的公共政策出台,既与问题和解决方法及其选择彼此相关,问题和解决方法之间也彼此相关,但不是因为它们之间存在手段和结果的关系,而是因为它们在时间上比较接近。甚至可以说,几乎任何一个政策创新都可以和任何一个问题相关——只要它们在同一时间出现。

As we all know, the sex trade is not a simple social problem, it has a very complex social causes, many governments are trying to stop this ugly social phenomenon. And when the government tried to prevent such illegal sex trade, it must decide to stop the buyer or seller. The governments of most countries will be sellers as the goals and efforts to track targets, because the only way to enable the Government to obtain the largest amount of investment interest. Therefore, in the United States, except in Nevada, some of the local transaction is considered legal, sex workers must be registered to the local government, and in particular the scope of the brothel to engage in business, health institutions for prostitutes to do a week of sexually transmitted diseases and AIDS test in addition, 49 other U.S. states have identified as the illicit trade in prostitution, the Government has adopted various means to be banned. It is clear that law enforcement agencies alone can not fundamentally resolve to combat the sex trade the problem.
Center for Disease Control and Prevention in Yizhou "training Miss" events to draw people and the sex trade should be legalized, whether the services have the right to dispose of their own bodies, social services, how to treat, the protective services of personal and property security and so on. In other words, the Government can take the best of both worlds in the end of the policy? Organizations through the dissemination of the litter in the decision-making methods of thinking, I believe that sex in the treatment of this complex decision-making, we must pay attention to the moral meaning of the policy to seize appropriate opportunities for decision-making, waiting for the right time for policy innovation.

[5] Clearly, such a dilemma in the current under control by the disease control departments of disease and maintenance of basic human rights of sex workers in the perspective of the "AIDS" health training, use of technical means to make up for deficiencies in law enforcement, and public manifestation of social progress sector responsibility, no doubt have a positive social meaning, this is the reality of social conditions in a realistic second-best moral choice.
(2) the appropriate policy decisions to grasp the opportunity. Government decision-making related to all aspects of the complexity of factors, not just a simple process of rational analysis. Therefore, we must patiently wait for the right opportunity for policy decisions. (3) waiting for a suitable time for policy innovation. Government, as the social management of the largest organizations of its decision-making rather than arbitrary. If in a particular environment, actors, solutions, issues and options there are complex interactions between, then the simplest is the time of the order of the source. In many ways, the effective policy for each of the innovation process on the establishment of the categories in terms of time, according to the synchronization problem, the people, problems and solutions together. [6] Therefore, the time constraints of policy innovation is a great strength. For example, in the United States, before the 1914 cocaine transactions are legitimate, today not. Alcoholic beverages in the United States today is legitimate, but in 1920 that between 1933 and did not. Prostitution in Nevada today is legitimate, in another 49 states are not. This has fully demonstrated that any government decision-making is a constant innovation to adapt to the process of social change. The occurrence of such innovation depends not only on the right opportunity, but also the appropriate decision-making depends on the correct time. In other words, innovation in government decision-making process, there are some exogenous, dependent on the timing of opportunities, problems, solutions and decision-makers. Often a rational and effective public policies introduced, not only with the problems and solutions related to each other and their choices, problems and solutions related between each other, but not because they exist between the relationship between means and results, but because their time more close. One could even say that almost any policy innovation can be a problem and any relevant - as long as they appear at the same time.
