农民被诊断为艾滋病险家破人亡 医院告之病好了

天水农民戴了4年“艾滋帽”
震惊 噩耗突来
近日，皮肤黝黑的李建平在兰州东方红广场与记者见了面，他个子不高，身材偏瘦，长得很精神。
和普通进城务工的农民一样，李建平保持着一份农民特有的淳朴，抽着几元钱的香烟，大口喝了一口冰镇矿泉水后，他说：事情发生在2003年，那一年，我得到噩耗，疾控中心通知我，我得了艾滋病……
邻居患病 他成为艾滋“嫌疑人”
2003年之前的几年，很多贫困的地方都出现过大规模组织卖血的情况，李建平生活的天水市金集镇瓦寨村是一个较贫困的地方，在那段时间中也曾有人组织过几十人乃至几百人出去卖血。卖血会带来各种传染性疾病，而最让人不寒而栗的就是艾滋病。2003年农历9月初，瓦寨村的一名村民由于曾经参加卖血，被当地卫生部门通知进行血液检测，结果表明这位村民已经是艾滋病患者。只有1000多居民的小村子，突然出现了艾滋病患者，这个情况立即引起了天水市疾控中心的重视。随后，天水市疾控中心立即组织了人员前往该村进行大规模的抽血采样，并携带回天水市进行艾滋病检测。
由于已被确诊的艾滋病患者正是李建平的邻居，所以村子里的大喇叭，通知要被抽血采样的名单中也列有李建平的名字。“当时就是进行血液采样，我虽然经常去兰州贩活鸡和土特产，但我的个人生活很清白，当时我的收入在村子里很高，每个月固定能挣2000元，所以我不需要去卖血。由于被确诊艾滋病的人是邻居，他前一段时间生病的时候，我给他扎过针，所以心里不踏实，毕竟我和他近距离接触过，所以我也很坦然地参加了这次集中血液采样的行动。”李建平对当时的情景还记忆犹新。李建平明白自己基本没有机会感染艾滋病，所以很自觉地参加了天水市疾控中心安排的集中血液采样。据瓦寨村村支部书记李贵海回忆，当时血液采样分三次进行，第一次有近60人参加，而第二次只有4人参加，第三次有40多人参加，而李建平参加的是第二次4人的血液采样。
晴天霹雳 幸福家庭被噩耗击碎
在李建平参加血液采样的4天后，和平时一样，他吃过中午饭，就站在自己家门前收拾新收割的荞麦。吹着山风很惬意地点上一枝烟，李建平正在品味自己蛮舒心的日子。“那时候日子真舒心，不愁吃不愁穿的，我做的生意每个月还能挣一千多元，有的时候挣得更多。在农村抽着3元钱的纸烟，喝着10元钱的白酒，我的生活让村里人无比羡慕，不管到谁家去都是热情地招待，村里人见了我都非常热情地打招呼。可是这样的日子好像被刀切了一样，瞬间就一去不复返了，从那辆疾驰过来的车停在我家门前之后，生活突然发生了180度的反转，我犹如掉入深渊一般生活在黑暗之中……”说起这些的时候，李建平的眼眶湿润了。
那天，天水市疾控中心的疾控车疾驰到他家门前，从车上下来了3个人，其中一名是清水县疾病预防控制中心主任张建国，跟他一起来的还有一名工作人员，还有一名就是天水市金集镇卫生院院长李本义。

一个老实巴交的天水农民，因为同村有人卖血患上艾滋病，他也被戴上艾滋病的“帽子”，突如其来的变故几乎让他家破人亡、妻离子散……这顶帽子一戴就是四年， 四年后，甘肃省天水市金集镇瓦寨村的李建平却被通知艾滋病好了。
作为治疗艾滋病的新武器，华裔科学家何大一教授所提出的“鸡尾酒”疗法一经公布就立即轰动了整个医学界。这个方法只是控制艾滋病的发展，依然无法彻底治愈艾滋病。 而发生在天水的这起“艾滋病事件”到底是一起正常的事件还是一次误诊，记者随即展开了调查。
三人下车后，立即将李建平叫到了家中。张建国对李建平说：“李建平啊，我给你说的事情，你要做好心理准备！”李建平当时心里非常明白，这些疾控中心的人是无事不登三宝殿的，莫非自己已经得了艾滋病？这个疑问顿时从李建平的脑中冒了出来：“张主任，你就直说吧，我是不是得了艾滋病？”张建国严肃地说：“经过对你的血液进行检测，你已经感染了艾滋病……”李建平顿时蒙住了，张建国说的每一个字犹如锥子般一下一下地扎着他的全身，让他坐在沙发上根本动不了。过了几分钟，李建平终于缓过神来，眼泪止不住地夺眶而出，四肢发麻的他整个人瘫倒在了沙发上。看到李建平的样子，在场的张建国不住地劝说着，随即带着工作人员迅速离开。据了解，李建平患有艾滋病的消息，当时在瓦寨村是保密的，知道的人只有李建平本人和他的父亲，还有一个人就是瓦寨村的村支部书记李贵海。据李贵海后来回忆，当全村进行血液检测之后，清水县疾控中心的工作人员拿了一个名单来到了瓦寨村，由于这个名单是保密的，见到名单的只有李贵海一人，在这个名单上列着所有参加血液检测的村民，李建平的诊断结果为HIV阳性，其余的村民全部都是HIV阴性。

如今在全世界还是难题的艾滋病，却在天水农民身上出现了“奇迹”——在确诊4年后，李建平的艾滋病居然“好了”！一句简单的“你的艾滋病已经好了！”为他“平了反”，在喜悦的同时，李建平心里甚是委曲。
从众人羡慕的生意人到大家下意识躲避的艾滋病患者，李建平的人生从此一落千丈。由于失去经济来源，一个本来富裕的家庭瞬间面临“土崩瓦解”，妻子和孩子也被怀疑得上艾滋病……突如其来的变故，甚至让李建平萌发轻生念头。
一落千丈
停止一切活计 这个家不再富裕
作为瓦寨村里第一个盖砖瓦房的李建平，在2003年时一直向兰州贩卖活鸡，还不时贩卖着一些土特产品，头脑灵活的他成为当时村子里家庭条件较好的家庭，不愁吃、不愁穿的李建平一家，过着别人羡慕的生活，两个孩子也都在上学，小儿子的成绩经常排在前三名。而在四年后，经历了“艾滋病”折磨的李建平一家，一个月的经济来源，只有李建平去工地当民工挣来的几百元收入，大儿子在他被宣布患有艾滋病之后，就辍学开始了打工，而小儿子也由于经济无法支撑，而休学打工，本来一个幸福的家庭就这样被艾滋病摧毁。
由于李建平被宣布为艾滋病患者，他的妻子张女商也被怀疑患有艾滋病，当时他的妻子正好在天水市麦积区打工，已经和李建平分居近20天。镇派出所知道情况后，立即派民警赶往麦积区，将李建平的妻子强行带往金集镇镇卫生院进行采集血样，并随后进行了检测。
经过检测，李建平的妻子张女商的检测结果为HIV阴性，没有感染艾滋病病毒。随后，李建平正在学校上课的两个儿子，也被强行采集了血样进行检测，经过检测两个孩子的HIV也为阴性。尽管李建平一家四口，只有他一人的检测结果为阳性，而这个普通而和睦的家庭却突然被艾滋病的阴云所笼罩。李建平和妻子被告知，不得再继续外出打工，更不能做贩卖活鸡和土特产的生意，一个本来富裕的家庭瞬间没有了主要的经济来源，仅有的就是清水县政府每个月发放的一百余元低保。
轻生念头不断 他曾经走近死亡
在被宣告为艾滋病患者后，由于没了经济来源，李建平一家开始坐吃山空，第二年大儿子便开始辍学在家，后来到兰州给别人打工为生。而小儿子一直学习很好，所以李建平不管怎样都要求小儿子继续上学，可是一个高中生的花销非常大，到去年年底，李建平已经无力支付小儿子的学费，随即小儿子也开始休学打工。看着小儿子的奖状，李建平不住地擦着眼泪：“小儿子书念得可好了，经常是班上的前三名，大儿子本来也在念书，但是由于我是这个病，两个儿子都辍学在家了，就是艾滋病让我耽误了孩子的一辈子前途！”
孩子由于自己是艾滋病而辍学，妻子由于这个原因只能待在家中，整个家庭已经被李建平的病拖垮，更让他接受不了的就是，以前在他眼里那个和睦的山村，顿时将他抛弃了。原来，李建平被宣布患有艾滋病的消息虽然是保密的，但疾控中心的车辆经常开到他家门前，而且每次都有工作人员进入他家，这就意味着李建平家肯定出了事情。李建平得了艾滋病的消息开始在整个山村蔓延起来。
本来热情的村民们开始对李建平表现出冷漠，更多的村民对他是躲避，只要李建平出现的地方，几乎所有人都找个借口离开。和李建平从小玩到大的李用义说：“我和李建平光屁股的时候就开始玩了，两家不分你我，相处得非常和睦。但是，当听说李建平得了艾滋病，为了保护自己我只能离他越来越远。”
面对越来越被孤立的自己，本来就心情难过的李建平几乎到了崩溃的边缘：“我当时只想一死了之，每次站在山崖上的时候，我就想一跃而下解脱自己和家人。但是，每当想起两个孩子从此没有了父亲，我就又会告诉自己，反正自己再有几年就会死了，这几年好好对待自己的孩子和老婆，让他们在我死之前能够获得更多自己应尽的责任。”
自从被确诊为艾滋病之后，一季度一次的血液检测，成为李建平日常生活中一个重要的组成部分。李建平说，后来我想开了，我关心自己的病情，我要掌握剩下的时间活出精彩来。生活就在阴霾笼罩中沉重地挣扎着，然而，老天却和李建平开了一个大的玩笑……2006年9月，他和以往一样在镇卫生院进行血液采样时，采样的工作人员的一个问题，让他顿时对自己的病情产生了怀疑，这一个不小心的怀疑，却掀开了一个巨大的秘密……
峰回路转
2006年年底，清水县疾控中心通知李建平去领取国家关怀艾滋病人的补助，在领取补助的时候，一名大夫突然询问李建平:你村是不是还有一名叫李建平的村民？李建平告诉他，是有一个叫李建平的村民，我们年龄相同。
随后李建平追问工作人员问这个问题是什么意思，这名工作人员含含糊糊地说了句：“问问，是不是搞错了。”李建平再问的时候，该工作人员便不再回答任何问题。
取了钱，李建平坐在回家的车上心里开始疑惑：“难道他们搞错了？我根本就没有艾滋病？”过了几天，李建平见到村中的另一个李建平时立即询问，另一个李建平告诉他，前两天县疾控中心的工作人员对他悄悄进行了血液采集并进行检测，结果为HIV阴性属正常。“为什么又要采集另一个李建平的血样检测？难道我真的没有艾滋病，是不是检测中出现了错误？是不是误诊了？”满脑子都是疑问的他开始联系县疾控中心的张建国主任。
随后，李建平多次致电清水县疾控中心的张建国主任询问自己的病情，并找到其本人当面咨询，均被告知李建平血液中的CD4值很高，而且身体情况也很好。据了解，正常成人的CD4细胞在每立方毫米500个到1600个，艾滋病病毒感染者的CD4细胞出现进行性或不规则性下降，标志着免疫系统受到严重损害，当CD4细胞小于每立方毫米200个时，可能发生多种机会性感染或肿瘤。CD4细胞起到“通风报信”的作用。
在此之后，定时定点每个季度的血液检测也不再通知李建平继续参加，这样李建平感觉到事情有些蹊跷。
2007年10月13日，李建平悄悄到天水市疾控中心自费进行了一次采集血液样本检测，而这次的结果表明李建平的CD4值在800以上，而该疾控中心的刘宝录主任说：CD4值在800以上，说明你身上的艾滋病病毒几乎为零，就是说你的艾滋病已经好了！”得到这样的答复，李建平心里已经肯定自己根本就没有得艾滋病，他随即拨通了省疾控中心的电话，要求到省疾控中心进行血液检测，但电话中省疾控中心工作人员让李建平不要到兰州，而是他们来天水找李建平。
整整4年，挣扎在轻生的边缘，李建平背负着艾滋病的“头衔”，将自己隐藏起来生活。但是，一句简单的“你的艾滋病已经好了！”就为李建平“平了反”，在长舒一口气一身轻松的同时，李建平不仅反问，就这样结束了？开始的那么沉重，结束的那么轻巧，这让李建平心里装满委曲，这是多么难过的4年！他心里一直有一个谜团，是谁给他这顶帽子，谁又为这顶帽子负责？
不解之谜
2007年10月19日，省疾控中心工作人员、天水市疾控中心刘宝录主任、清水县疾控中心张建国主任一行来到了李建平家。他们宣布：“李建平的艾滋病已经好了！”简单的一句话，就为挣扎在死亡边缘的李建平“平了反”，这让心情激动的李建平变得心情复杂，李建平当即质问在场的疾控中心领导，他的艾滋病是怎么治好的？面对这个问题，在场的人无人回答。
随后，李建平又悄悄地来到兰州市疾控中心及省疾控中心采集血液样本进行了检测，检测报告结果都是HIV呈阴性，也就说明李建平没有艾滋病。
回忆当时李建平得到平反的事，瓦寨村村支部书记李贵海说：“他的事情，在村子里是保密的，但实际上这件事大家也都知道，得到‘平反’后，他无法平静自己的心情，他怕人们不相信自己没有艾滋病，所以我们开了个会，为李建平开具了一个证明，证明李建平的病已好。”
李建平说，“这4年，别人不和我打交道，我更不主动去接近别人，每天就待在家里。每个季度，镇卫生院的李本义院长就会定时通知我，让我去卫生院进行艾滋病的跟踪血液采样，从2003年10月第一次进行检测之后，直到2007年9月我一共跟踪血液采样了16次。”
让人感到意外的是，李建平从第一次检测开始，直到最后一次定期检测，他从来也没有见过任何一张病情的检测报告，就连血样检测化验单也从未见过一张。从被宣布为艾滋病患者开始，就一直都是由各级疾控中心的负责人和工作人员口头告知李建平本人的。“我们农村人没那么强的意识，来宣布我得病的人都是专家和领导，听完自己有病后我就完全相信了，根本没有任何怀疑……”李建平回忆。

艾滋病可以完全康复吗？也许这是一个根本不用提的问题，目前世界上还没有彻底治疗艾滋病的方法，天水农民李建平目前健康的身体，以及天水市疾控中心表示李建平的艾滋病“好了”的表态，是否能说明当初的诊断就不准确？
作为艾滋病防治的三级疾控中心，对病人的诊断过程是否有相关部门监管？如果有对检测流程的监管，是否还会出现类似的情况？发生在天水市清水县的“艾滋病不治自愈事件”，凸显一连串的疑团，西部商报记者随即展开了对天水市、清水县以及金集镇三级卫生部门的调查，试图揭开其中的疑问。

甘肃政法学院公安系副院长马宏平：当事人李建平可以向三级疾控中心提出民事诉讼，要求获得精神赔偿。如果当事人李建平并未真的患有艾滋病，而该事实三级疾控中心如果提前就已知晓，或在半年到一年内得到检测结果表明李建平确实没有患有艾滋病，那么疾控中心就可能故意隐瞒，却未告知当事人，这就是玩忽职守的做法。当事人在4年中的名誉权被损害，并以健康的身体不断服用抗艾滋病的药品并不断接受检测，这对其身体健康会造成损害，而当事人在被告知患有艾滋病后就导致无法继续打工，家中的承包地也因此闲置，造成重大经济损失，导致大孩子辍学在家，小孩子在别人歧视的眼神下勉强上学。上述这些在民事诉讼中，都可提起相应赔偿。
据了解，李建平已向律师咨询，并准备向三级疾控中心提出诉讼。
一个“病好了”的说法，就让李建平得到了平反，但4年的痛苦煎熬，家庭的没落，李建平无法让这件事就此简单地过去。带着三份HIV呈阴性的检验单，李建平开始为自己找“说法”。
金集镇卫生院院长
防记者玩起“躲猫猫”
7月30日，记者和李建平来到了4年中经常接触的金集镇卫生院。到达该院后，记者和李建平未在院长办公室见到院长李本义。记者随即拨打李本义的电话，接通后，李本义说自己不在医院，两天后才能回来，但在通话中，记者能够隐约听出对方的声音从附近传来。随即记者一边打电话一边寻找，当走到二楼最里的一间办公室后，李本义突然挂断电话，随即电话也成关机状态。只不过是普通了解情况，李本义为何要躲避当事人与记者？在多次敲门未有回应后，李建平爬上办公室房门，从门上打开的窗户上发现，李本义就在办公室的角落中站着。看到李建平已经发现自己，无法再躲藏的他终于打开房门，将记者和李建平带到会议室。对于李本义“躲猫猫”的情况，李本义解释是由于艾滋病要保密，主要是防记者，所以才会回避。
据了解，金集镇瓦寨村属于金集镇卫生院的医疗保障范围，2003年第一次到瓦寨村进行血液检测，李本义是主要负责人之一。看着李建平的化验单，李本义说：“我只是行使自己的职责，因为艾滋病防治工作中，很多地方都需要保密，李建平得了艾滋病的事，上级疾控中心工作人员对我也是回避的。2003年10月，当时宣布李建平得病时，虽然我也一起去了李建平家，但主要是为县、市疾控中心的工作人员领路，而且宣布时我被安排在院子里等候。”
记者向李本义询问：“李建平的第一次诊断是否准确？”李本义回答：“4年中，我是按照上级的指示通知李建平到镇卫生院进行血液检测，根本没有对李建平的病情做出过判断和询问，也没有见过任何的检测化验单据。按照检验流程，李建平4年间一直在镇卫生院进行检测，但如果李建平没有艾滋病，也不会被通知每季度来采集血样。”

质疑艾滋病能自愈？
记者在瓦寨村了解到，李建平得艾滋病，在瓦寨村早已是公开的秘密。除了村子里的大夫李四友不嫌弃李建平外，李建平其实现在已经没有什么朋友。对于李建平得病的事，李四友说：“作为一名医务工作者，我有责任对他的病情保密。但是，艾滋病这种目前世界上无法治愈的疾病，在李建平身上突然间痊愈了，这种病自我痊愈的几率几乎为零，那只能说明一个问题——第一次的检测结果是误诊。”
李建平自述：“误诊的情况我可以接受，毕竟在医疗检查过程中无可避免地会出现错误。但是，一次误诊的结果，竟然可以大过16次复查的结果，这让人无法接受。每当我向疾控中心询问病情时，得到的答复全部都是‘保密’二字。对病人的病情保密，这无可厚非，但对病人自己保密，而且不提供任何书面单据，这让人无法理解。”

2006年就知道“他没病”
李本义表示，由于艾滋病保密的制度，所以对于李建平的病情，他从来没有过问过。之后的第二天，记者和李建平又来到了天水市清水县疾控中心，据了解，该中心张建国主任就是亲自宣布李建平得病的人。对于李建平这4年来的艰难生活，他非常了解。
7月31日上午11时，记者和李建平在清水县疾控中心的楼梯上，遇到了准备离去的张建国。随即，张建国将李建平带到疾控中心后院一个无人的地方，说：“我就知道你不可能就这么让事情平息的！”随后，李建平向张建国询问：“我每季度的血液检测结果是什么样的？那些结果是否都显示HIV呈阴性？如果结果呈HIV阴性，那么16次跟踪检测的结果是否相同？”面对这些问题，张建国的回答让人震惊，“实际上，2006年从你的检测结果来看，就知道你身体是好的。”
天水市疾控中心
只承认“病好了”
既然清水县疾控中心早在2006年就已经知道李建平没有艾滋病，那么上级部门天水市疾控中心又如何解释？随后，记者与李建平又赶往天水市疾控中心，找到了该中心刘宝录主任。其实，一年多之前，李建平就找到过刘宝录，经过两人近三个小时的交谈，刘宝录当时告诉李建平，李建平所得的艾滋病经过4年的检查之后发现“病好了”，却丝毫没有说李建平的艾滋病是否存在误诊，更没有说为何迟迟没有告知李建平本人他没病,只是表示具体情况自己不清楚。当日，记者与李建平来到天水市疾控中心后，刘宝录说：“2003年确诊李建平已得了艾滋病的情况是后来才知道的，宣布李建平艾滋病好了的时候，我确实在场。”李建平追问：“为什么从2003年第一次检测到现在，我都没有见到任何的检验单据？”刘宝录回答：“对于你说的情况，我不清楚。”
关于流程
检测结果呈阴性 应向当事人提供检测报告
根据国务院1988年颁布实施的《艾滋病监测管理规定》第三条：各级卫生行政部门主管辖区内的艾滋病监测管理工作；三级疾控中心在检测艾滋病时，按照这条规定自己监督自己，没有第三方对检测结果进行二次监督。
昨日，记者从省疾控中心了解到，对于艾滋病的检测，检测结果HIV如果呈阴性，将给受检者提供检验报告单，如果HIV呈阳性，将通知其参加每周一次的血液检测，对第一次检测结果呈假阳性的，将在一周之内检验出结果，结果如果依然呈现阳性，就需要在半年内跟踪检测，期间，如果确认受检人呈现阴性结果，要向受检者提供检测报告单。按省级疾控中心对艾滋病防治的流程，天水市疾控中心在第一次检测后，得到了李建平HIV呈阳性的结果，随即就将该结果告知了李建平，但未提供检验报告，而随后李建平复检的结果，天水市疾控中心也未提供任何的检验报告单。经过半年的跟踪检测后，李建平的检验结果也一直没有公布，直到4年后，李建平向疾控中心负责人咨询后，才得知自己确实没有感染艾滋病病毒。
