    备受关注的我国首例“艾滋病就业歧视第一案”一审有了结果。11月12日下午15时,安徽省安庆市迎江区人民法院对该案进行宣判。法院认为,两被告(安庆市教育局、人保局)在教师招聘中适用公务员录用体检标准并无不妥,且对原告做出的拒绝录用决定符合法律规定。法院驳回了原告小吴(化名)全部诉讼请求。小吴代理人当庭表示不服一审判决,将上诉至安庆市中级人民法院。

    法院宣判时,当事人小吴并未在场,小吴的代理律师于方强第一时间将法院的判决结果告诉了小吴,小吴表示要将维权的道路走到底,他期待二审判决有好的结果。

    记者拨打小吴的手机,始终无人接听。小吴的博客上,记者看到一行文字:“我很茫然很失望很伤心很无助很无奈很可怜很悲剧……唉,我本身在悬崖边上,安庆法院的一锤无疑让我坠入万丈深渊”。


    据于方强律师介绍,自10月13日法院开庭审理此案后,小吴一直处于煎熬之中。小吴说,歧视是一堵墙,需要很多人一个一个地撞,“以前,乙肝也是这样(受歧视),社会现在对乙肝开始接受了,这是一个很好的例子”。

    法院认为,《安庆市市直事业单位公开招聘和选调人员办法》是依据部门规章授权目的和范围制定的地方政府规范性文件,其规定内容与上位法规定并不冲突。而被告依据该《办法》规定,参照《公务员录用体检通用标准(试行)》,对招聘教师进行体检,并无不妥。根据《中华人民共和国教师法》与《中华人民共和国教师资格条例》规定,教师的教育教学能力应当符合国家规定的从事教育教学的身体条件。而根据《公务员录用体检通用标准(试行)》第十八条规定,原告体检不合格,不符合《教师法》对从事教师职业身体条件的要求。
