贺成：即抓即放艾滋病毒贩暴露出的执法担当

10月29日中午，广东东莞凤岗镇官井头村两名嫌疑人贩毒时被治安巡逻人员当场抓获；民警赶到现场后将其中一人释放，只因其疑似患有艾滋病、肺结核。警方称“抓了去监狱也不要”，只能放了他。警方表示，这些“特殊”违法人员自恃患病，屡屡作案，非常无奈。（11月7日《广州日报》）
该民警的做法，肯定是有失妥当。首先，对艾滋病的判断，不是一个警察肉眼可以看得出来的，凭着“疑似”感觉将其释放，未免显得过于草率；其次，对于一个犯罪主体基本属实的人，警察并无权利即抓即放；最后，艾滋病人再特殊，也只是享受医疗政策方面的优惠，而在法律面前还是平等的，并没有被豁免的权利。
称监狱不收艾滋病犯人，这也是缺乏根据的，更像是在狡辩。因此，尽管该警察拿一些内部规则来忽悠公众，但我们还是不难判断该警察是怎样的一个执法者？要不就是患有“恐艾症”，害怕接下来的更多接触中自然染病；要么就是跟网友说戏言的那样：跟毒犯有勾搭！
从毒犯角度说，还是从艾滋病角度论，对社会的危害都是不可低估的，都应及时控制，妥善处理——这不仅是对犯人或者病人的交代，更是对社会公众安全的负责。这种即抓即放做法，显然暴露出执法者令人担忧的执法担当现状。
