艾滋病毒贩，怎成了“免死金牌”

10月29日中午，广东东莞凤岗镇官井头村两名嫌疑人贩毒时被治安巡逻人员当场抓获;民警赶到现场后将其中一人释放，只因其疑似患有艾滋病、肺结核。警方称“抓了去监狱也不要”，只能放了他。警方表示，这些“特殊”违法人员自恃患病，屡屡作案，非常无奈。据(广州日报11月7日)
首先，这种艾滋病毒贩入监难的问题，应当得到国家的高度重视;如果说艾滋病、肺结核能够成为“免死金牌”的话;那么，日后是否会出现更多的艾滋病毒贩，而将这些艾滋病毒贩直接的释放给社会，无疑是对整个社会造成了更多的伤害，这其中不仅仅是毒贩的张狂，更多的是对人们造成的传染伤害，这种伤害是可怕的，是急需大力整治的，更需国家立法机关准确出台整治法律、法规的。
除了严厉打击毒贩，还应当在监狱的设施上下功夫，真正的建立几个艾滋病、肺结核的监狱，因为这种监狱的建立是当前的重中之重，更是人们所希望的，必定这种“免死金牌”在社会上会造成更大的危险和伤害。只有在专门特设的监狱内实行关押和治疗，相信这才是人们希望看到的，并不是撒手不管扔给社会。
其次，按照我国现行的法律、法规确实对这些人无法准确的实施关押，应当说看守所条例、《强制戒毒办法》、监狱法等均为看守所和监狱拒绝艾滋病人留下了空间，但仅仅是留下一定的空间，不能说不去具体的复查或者通过医院检验就释放，也不能听从毒贩的自行吹嘘就放人，应当真正的提高对这种病的准确度的认定，只有这样子才是对社会群众的高度负责。
应当说，艾滋病人的毒贩对于司法机关来讲，目前是面临着一个十分棘手的问题，但是有问题，总有解决的办法。相信在国家的严厉打击下，建立一个新的规范的“病区监狱”势在必行，或者是否可以变相的惩罚和告诫，适用一些得当的法律“限行管制”，同时针对这种病人的毒贩实行“汇报管制”，只限定在一定时间内必须向某医院或者司法机关汇报一次，或复查一次，以确信不能给社会带来更大的伤害。
最后，希望“法外特权”的艾滋病犯人能够得到更有效的整治。
