《口岸艾滋病防治管理办法》意见稿公布

        中新网11月26日电 国家质检总局网站日前公布《国家质量监督检验检疫总局关于修改<口岸艾滋病防治管理办法>的决定(征求意见稿)》,并向社会公开征求意见,意见收集截止日期为12月5日。

    征求意见稿全文如下:

    国家质量监督检验检疫总局关于修改《口岸艾滋病防治管理办法》的决定

    (征求意见稿)

    根据《国务院关于修改〈中华人民共和国国境卫生检疫法实施细则〉的决定》(中华人民共和国国务院令第574号),国家质量监督检验检疫总局决定对《口岸艾滋病防治管理办法》作如下修改:

    一、题目修改为:“口岸艾滋病预防控制管理办法”。

    二、第八条修改为:“患有艾滋病或者感染艾滋病病毒的入境人员,在入境时应当如实向检验检疫机构申报,检验检疫机构应当对其进行健康咨询,并及时通知其目的地的疾病预防控制部门。”

    三、删除第九条。

    四、删除第十六条第二款。

    本决定自公布之日起施行。

    《口岸艾滋病防治管理办法》根据本决定作相应的修订,重新公布。

    口岸艾滋病预防控制管理办法

    第一章 总 则

    第一条 为了做好国境口岸艾滋病的预防、控制工作,保障人体健康和口岸公共卫生,依据《中华人民共和国国境卫生检疫法》及其实施细则和《艾滋病防治条例》等法律法规的规定,制定本办法。

    第二条 本办法适用于口岸艾滋病的检疫、监测、疫情报告及控制、宣传教育等工作。

    第三条 国家质量监督检验检疫总局(以下简称国家质检总局)主管全国口岸艾滋病预防控制工作,负责制定口岸艾滋病预防控制总体规划,对全国口岸艾滋病预防控制工作进行组织、协调和管理。

    第四条 国家质检总局设在各地的出入境检验检疫机构(以下简称检验检疫机构)负责制定所辖口岸区域艾滋病预防控制的工作计划,对口岸艾滋病预防控制工作进行组织、协调和管理,实施检疫、监测、疫情报告及控制、开展宣传教育。

    第五条 检验检疫机构应当配合当地政府做好艾滋病预防控制工作,与地方各级卫生行政主管部门、疾病预防控制机构、公安机关、边防检查机关等建立协作机制,将口岸监控艾滋病的措施与地方的预防控制行动计划接轨,共同做好口岸艾滋病预防控制及病毒感染者和艾滋病病人的监控工作。

    第六条 检验检疫机构应当在出入境口岸加强艾滋病防治的宣传教育工作,对入出境人员有针对性地提供艾滋病防治的咨询和指导,并设立咨询电话,向社会公布。

    第二章 口岸检疫

    第七条 检验检疫机构应当加强对入出境人员以及入出境微生物、人体组织、生物制品、血液及其制品等物品(以下简称特殊物品)的检疫和监督管理工作。

    第八条 患有艾滋病或者感染艾滋病病毒的入境人员,在入境时应当如实向检验检疫机构申报,检验检疫机构应当对其进行健康咨询,并及时通知其目的地的疾病预防控制部门。

    第九条 申请出境1年以上的中国公民以及在国际通航的交通工具上工作的中国籍员工,应当持有检验检疫机构或者县级以上医院出具的含艾滋病检测结果的有效健康检查证明。

    第十条 申请来华居留的境外人员,应当到检验检疫机构进行健康体检,凭检验检疫机构出具的含艾滋病检测结果的有效健康检查证明到公安机关办理居留手续。

    第三章 口岸监测

    第十一条 国家质检总局应当建立健全口岸艾滋病监测网络。检验检疫机构根据口岸艾滋病流行趋势,设立口岸艾滋病监测点,并报国家质检总局备案。

    检验检疫机构按照国务院卫生行政主管部门和国家质检总局制定的艾滋病监测工作规范,开展艾滋病的监测工作,根据疫情变化情况和流行趋势,加强入出境重点人群的艾滋病监测。

    第十二条 国家质检总局根据口岸艾滋病预防控制工作的需要,确定艾滋病筛查实验室和确证实验室。艾滋病筛查和确证实验室应当按照国家菌(毒)种和实验室生物安全管理的有关规定开展工作。

    检验检疫机构承担艾滋病检测工作的实验室应当符合国务院卫生主管部门的标准和规范并经验收合格,方可开展艾滋病病毒抗体及相关检测工作。

    第十三条 检验检疫机构为自愿接受艾滋病咨询和检测的人员提供咨询和筛查检测,发现艾滋病病毒抗体阳性的,应当及时将样本送艾滋病确证实验室进行确证。

    第十四条 检验检疫机构应当按照国家有关规定,严格执行标准操作规程、生物安全管理制度及消毒管理制度,防止艾滋病医源性感染的发生。

    第四章 疫情报告及控制

    第十五条 检验检疫机构及其工作人员发现艾滋病病毒感染者和艾滋病病人时,应当按照出入境口岸卫生检疫信息报告的相关规定报告疫情。

    第十六条 检验检疫机构应当按照有关法律法规的规定及时向当地卫生行政部门通报口岸艾滋病疫情信息。

    第十七条 检验检疫机构应当对检出的艾滋病病毒感染者、艾滋病病人进行流行病学调查,提供艾滋病防治咨询服务。艾滋病病毒感染者、艾滋病病人应当配合检验检疫机构的调查工作并接受相应的医学指导。

    第十八条 检验检疫机构为掌握或者控制艾滋病疫情进行相关调查时,被调查单位和个人必须提供真实信息,不得隐瞒或者编造虚假信息。

    未经本人或者其监护人同意,检验检疫机构及其工作人员不得公开艾滋病病毒感染者、艾滋病病人的相关信息。

    第十九条 检验检疫机构应当对有证据证明可能被艾滋病病毒污染的物品,进行封存、检验或者消毒。经检验,属于被艾滋病病毒污染的物品,应当进行卫生处理或者予以销毁。

    第五章 保障措施

    第二十条 口岸艾滋病预防控制经费由国家质检总局纳入预算,设立检验检疫机构艾滋病防治专项经费项目,用于艾滋病实验室建设及口岸艾滋病的预防控制工作。

    第二十一条 检验检疫机构负责所辖口岸艾滋病预防控制专业队伍建设,配备合格的专业人员,开展专业技能的培训。

    第二十二条 艾滋病预防控制资金要保证专款专用,提高资金使用效益,严禁截留或者挪作他用。

    第六章 法律责任

    第二十三条 任何单位和个人违反本办法规定,不配合检验检疫机构进行艾滋病疫情调查和控制的,检验检疫机构应当责令其改正;情节严重的,根据《中华人民共和国国境卫生检疫法》及其实施细则的有关规定予以处罚;构成犯罪的,依法追究刑事责任。

    第二十四条 检验检疫机构未依照本办法的规定履行艾滋病预防控制管理和监督保障职责的,根据《艾滋病防治条例》的有关规定,由上级机关责令改正,通报批评。

    第二十五条 检验检疫机构工作人员违反本办法规定有下列情形,造成艾滋病传播、流行以及其他严重后果的,由其所在单位依法给予行政处分;构成犯罪的,依法追究刑事责任:

    (一)未依法履行艾滋病疫情监测、报告、通报或者公布职责,或者隐瞒、谎报、缓报和漏报艾滋病疫情的;

    (二)发生或者可能发生艾滋病传播时未及时采取预防控制措施的;

    (三)未依法履行监督检查职责,发现违法行为不及时查处的;

    (四)未按照技术规范和要求进行艾滋病病毒相关检测的;

    (五)故意泄露艾滋病病毒感染者、艾滋病病人涉及个人隐私的有关信息、资料的;

    (六)其他失职、渎职行为。

    第七章 附 则

    第二十六条 本办法由国家质检总局负责解释。

    第二十七条 本办法自2007年12月1日起施行。此前规定与本办法不一致的,以本办法为准。

According to "the State Council on Amending <Frontier Health and Quarantine Law of the implementation details> of the decision" (PRC State Council Order No. 574), the State General Administration of Quality Supervision, Inspection and Quarantine of the "port of AIDS Prevention and Control Measures" be amended as follows:

    
First, is revised as: "Port of AIDS prevention and control management approach."

    
Second, Article VIII is amended as: "People with AIDS or HIV immigration officers upon entry inspection and quarantine institution shall truthfully declare to the inspection and quarantine institutions shall conduct their health advice, and inform the destination of disease prevention and control sector. "

    
Third, delete Article IX.

    
Fourth, remove the second paragraph of Article XVI.

    
This Decision shall take effect the date of publication.

Port AIDS Prevention and Management Measures

    
Chapter I General Provisions

Chapter II Inspection and Quarantine

Chapter safeguards

Twenty-four inspection and quarantine institution fails to perform in accordance with the provisions hereof AIDS prevention and control management and supervision of security responsibilities, according to the "AIDS Prevention and Control Act" the relevant provisions, the superior organ shall order him criticism.

Chapter VII Supplementary Provisions
